1.General provisions
1.1. These terms and conditions of sale (hereinafter: terms and conditions) of the FV Rackets e-store (hereinafter: e-store) apply to purchases made from the FV Rackets e-store at the Internet address www.fvtennis.ee. The seller of the goods is Tenniseakadeemia OÜ (hereinafter referred to as the seller), located at Haabersti 5, 13516 Tallinn, registration code 12716502, tel +372 5660 6001, e-mail address info@fvtennis.ee. The terms and conditions apply to all legal relationships arising between persons (hereinafter referred to as the customer) and the seller when purchasing goods through the FV Rackets e-store.
1.2. The seller has the right to unilaterally change and supplement the terms and conditions by publishing the new terms and conditions on the website https://fvtennis.ee/muugitingimused/. If the customer placed an order before the changes to the terms and conditions came into effect, the terms and conditions valid at the time of placing the order shall apply to the legal relationship between the customer and the seller.
1.3. Before making a purchase, the customer can save, print, and, if necessary, reproduce the terms and conditions. By making a purchase in the online store, the customer agrees to the terms and conditions set forth herein.
1.4. In addition to these terms and conditions, purchases made in the e-store are subject to the laws and regulations in force in the Republic of Estonia.
2. Products in the online store
2.1. The online store may contain products that are only available in limited quantities and are special editions. Limited quantity products can be returned or exchanged in accordance with the seller's return policy. The online store cannot always guarantee the availability of products. If a customer places an order in the online store but the product is not available, the online store will not be able to fulfill the order. In this case, the seller will contact the customer and offer a new availability date for the same product, a replacement product, or a refund of the purchase price within 14 calendar days.
2.2. Product photos in the online store are illustrative, but captured using the best solutions available. The appearance of products on a computer monitor or smart device screen may differ from reality to some extent, depending on the color accuracy of the device or monitor.
3. Placing an order
3.1. The customer selects the desired goods from the online store, selects the product characteristics (if any) and adds them to the shopping cart.
3.2. Products in the shopping cart are not reserved.
3.3. The customer chooses the method and place of delivery of the order.
3.4. The customer confirms the shopping cart and pays for the goods in the payment environment offered by the seller. Before paying the invoice, the customer checks that the information on the invoice corresponds to the customer's actual wishes.
3.5. After paying for the goods, the customer must click on the link “Back to merchant.”
3.6. The seller will send the customer confirmation of the order and payment receipt by email.
3.7. The sales contract between the seller and the customer shall enter into force upon receipt of the full purchase price paid by the customer in the seller's bank account.
3.8. If the product ordered by the customer is unavailable, the seller will cancel the order. The order may be canceled either partially or completely. The customer will be informed immediately of the cancellation of the order. In the event of a partial cancellation, the seller may ask the customer how they wish to proceed with the remaining order – whether to ship it or cancel it as well.
4. Price of goods, payment options
4.1. All prices of goods sold in the e-store are shown in euros and include VAT.
4.2. The customer shall pay the full amount of the sales price of the goods and the delivery fee in advance. Payment shall be made outside the online store in a secure environment. The seller shall not have access to the customer's bank and credit card details.
4.3. A service fee may be added to the cost of the order in accordance with the agreement concluded between the customer and the bank or credit card issuer.
5. Receipt of goods
5.1. Goods can be ordered to a Smartpost parcel terminal or to an address entered by the customer using the SmartKull service.
5.3. Receiving goods from a Smartpost parcel terminal
5.3.1. Delivery of goods to a Smartpost parcel terminal selected by the customer is free of charge within Estonia.
5.3.2. The goods will be shipped within 1-2 business days and will arrive at the parcel terminal within 1-2 business days after posting.
5.3.3. The customer will be notified of the arrival of the shipment and its location via SMS. The message will contain the door code required to open the door. The shipment will be stored in the parcel terminal for 7 calendar days.
5.3.4. If the customer has not collected the goods from the parcel terminal by the end of the storage period, the seller shall consider that the customer has canceled the order and shall refund the purchase price together with the delivery fee to the customer immediately, but no later than within 14 calendar days to the same bank account from which the purchase was paid for.
5.3.5. The seller is not liable for any damage incurred by the customer if, for reasons not attributable to the seller, third parties have obtained the unique code of the parcel terminal and the goods have been collected on that basis.
5.4. Receiving goods with SmartKuller within Estonia
5.4.1. The SmartKuller service is free of charge within Estonia.
5.4.2. Goods delivered by SmartKuller will be delivered to the address specified by the customer within 2-3 business days after the sales contract enters into force, Monday through Saturday between 9:00 a.m. and 9:00 p.m. The customer can choose a suitable time slot for receiving the shipment (9:00 a.m. to 5:00 p.m., 5:00 p.m. to 9:00 p.m., or 9:00 a.m. to 9:00 p.m.) and order the goods to be delivered to their workplace or home. On the morning of the delivery day, the customer will receive an SMS notification about the arrival of the parcel. The courier will call the customer before delivering the parcel. At the customer's request, the shipment can also be redirected to a suitable parcel terminal at no extra charge. The shipment is handed over to the customer on the basis of a unique code, which is sent to the customer via SMS.
5.4.3. The customer must ensure that they are available to receive the goods at the agreed time and address. If the customer is not available when the goods arrive, the courier will return the parcel to the Smartpost terminal. When the package arrives back at the terminal, the system will send an SMS to the customer. The customer can then agree with Smartpost customer service on a new time for the courier to make the next delivery attempt.
5.5. Receiving goods with SmartKuller in a foreign country
5.5.1. Goods can be ordered to the following countries: Estonia, Latvia, Lithuania, Finland, Sweden, and Russia.
5.5.2. When ordering to a foreign country, a delivery fee corresponding to the destination selected by the customer will be added during the ordering process. The delivery method is selected and the delivery fee is calculated in the shopping cart. Depending on the destination, the delivery fee is:
Latvia: €9, Lithuania €9, Finland €17, Sweden €23, Russia €45.
5.5.3. Goods delivered by SmartKuller will be delivered to the address specified by the customer within 6-8 business days after the sales contract enters into force.
5.6. Inspection of goods
5.6.1. Upon receipt of the goods, the customer undertakes to open the product packaging carefully, without damaging the packaging or products. If the customer has damaged the packaging due to carelessness, i.e. it was possible to open the product packaging without damaging it, the seller has the right to demand compensation for the damage caused when returning the goods. If the product packaging cannot be opened without damaging or breaking it, the customer is not liable for the damaged packaging.
5.6.2. If, upon receipt of the goods, the customer discovers that the wrong or defective goods have been sent to them, or that the goods have not arrived in good condition and in sealed packaging, they must immediately notify the seller's customer service by calling +372 5660 6001 or sending an email to info@fvtennis.ee.
5.6.3. The seller is responsible for the goods purchased by the customer during transport. From the moment of receipt of the goods, the risk of damage or loss of the goods passes to the customer.
6. Processing of customer personal data
6.1. The Seller processes the personal data entered by the Customer in the online store (including name, phone number, address, email address, phone number) primarily for the purpose of fulfilling the order and delivering the goods to the Customer in accordance with the Seller's privacy policy.
7. Returning goods, withdrawing from the contract, and refunds
7.1. The customer has the right to withdraw from the contract without giving any reason within 14 calendar days of receiving the goods (except in the case of product defects, see clause 8), by contacting the e-store customer support by phone at +372 5660 6001 or by e-mail at info@fvtennis.ee.
7.2. When exercising the right of withdrawal, the customer is obliged to return the goods to the seller within 14 days of submitting the return request.
7.3. The customer may exercise their right to withdraw from the contract if the goods are unused and undamaged. We recommend that customers return or deliver all goods they wish to return at the same time. We recommend returning the goods in their original packaging.
7.4. Returned goods must be unused and undamaged. Products with the price tag, product name, and product codes removed cannot be returned. The customer has the right to examine the goods in the manner permitted in a regular store, and the customer is responsible for any decrease in the value of the goods when examining them if they have used the goods in a manner other than that described above.
7.5. If the customer has withdrawn from the transaction, the seller shall refund the purchase price to the customer together with the delivery fee without delay, but no later than 14 calendar days after the withdrawal notice has reached the seller. The refund shall be made to the same bank account from which the purchase was paid for.
7.6. If the customer has damaged or destroyed the returned goods intentionally or through negligence, the seller has the right to refuse to accept the goods or to demand compensation for the damage caused.
7.7. The customer shall pay for the transport of the returned goods, except in cases where the goods are defective. The cost of transporting defective goods shall be refunded to the customer's account from which the purchase was made.
8. Exchange of goods
8.1. If the customer wishes to exchange or replace a product, they must contact info@fvtennis.ee. In the event of an exchange or replacement, the customer shall bear all direct costs associated with returning the product, unless the product being returned is defective.
8.2. If the product returned to the seller cannot be exchanged due to the lack of the size requested by the customer, the seller will contact the customer.
9. Submission of claims and liability
9.1. The seller is liable for any non-conformity of the purchased goods for a period of 2 years from the date of delivery of the goods to the customer. When goods are sold to a customer, it is presumed that any non-conformity with the terms of the contract that becomes apparent within six months of the date of delivery to the customer existed at the time of delivery, unless such a presumption is contrary to the nature of the item or defect. The customer undertakes to notify the seller of any non-conformity of the goods within two months of its discovery, i.e. to submit a claim.
9.2. The customer may submit a claim by e-mail to info@fvtennis.ee. The claim must include the customer's name and contact details, the date of submission of the claim, the defect found in the goods, and the content of the claim, and a document proving the purchase must be attached.
9.3. The Seller shall not be liable for any damage or other consequences arising from incorrect information provided by the Customer when placing an order, including delays in delivery, if this is due to circumstances beyond the Seller's control.
9.4. The Seller shall not be liable for any damage caused by the improper use of the ordered goods.
9.5 Any disputes arising between the seller and the customer shall be resolved by negotiation between the parties. If no agreement is reached, the customer has the right to contact the Consumer Protection and Technical Regulatory Authority's Consumer Environment Department (Pronksi 12 Tallinn 10117,https://www.ttja.ee) and the Consumer Disputes Committee (Pronksi 12 Tallinn 10117,http://www.komisjon.ee) for out-of-court dispute resolution or to the Harju County Court. In addition, the European Union's electronic environment ODR platform (Online Dispute Resolution) athttp://ec.europa.eu/odr is open to all customers for resolving complaints arising from e-traders.
10. Montonio's installment plan and use of Split
10.1 Montonio installment plan: one application – multiple offers.
Use the Montonio installment plan to pay – with one application, you will receive offers from multiple
lenders. Add the desired products to your shopping cart and select Montonio installment plan as your payment method.
Select the appropriate contract period and fill out the application. Through the installment payment platform, you will receive financing offers from several
lenders. Review the terms and conditions and choose the one that suits you best.
Installment payment terms and conditions:
- Amount financed with deferred payment: €100–10,000
- Period 3–60 months
- Interest starting at 5.9% of the initial amount
10.2 Montonio Split: one large purchase – three small payments.
Use the Montonio Split solution to pay for your purchase later in the same month or in three equal installments over three months.
Add the desired products to your shopping cart and select Montonio Split as your payment method. You can pay for your purchase 30
days later, in two installments over two months, or in three installments over three months. If you wish, you can
pay the entire purchase amount before the due date at a time of your choosing.
